Misleads Judge Into Issuing Judgement That CO GOP Owes Klenda 1,000
Brita Horn’s final act as CO GOP Chair – before resigning in disgrace – was to
launch a financial attack on the CO GOP aimed at crippling the Party heading
into the midterms and potentially for years to come.
Hours before her resignation was to take eAect Horn and her personal
attorney Steve Klenda secretly went to court and got the judge to sign oA on an
oAicial agreement that the CO GOP owed and had to pay Klenda $231,000
dollars plus interest and waived all defenses. This was not the judge who had
been handling lawsuits involving Horn, Klenda and party members and was
familiar with Horn and Klenda antics.
Instead, they deliberately sought a judge who had none of the necessary
background information.
Klenda told the judge the Party owed him $231,000 dollars plus 18% interest.
Horn who told the judge as Chair she represented the Party – agreed with
Klenda. So, the judge granted Klenda’s motion for the judgement.
Horn and Klenda hid from the judge the fact that Horn was resigning in a
matter of hours, they hid any and all information about the ongoing dispute
over Klenda’s hiring and billing. Including the fact that the owed amount
includes $90,000 of Horn’s personal legal bills. (BTW This is not the first time
Horn and Klenda misled a court – they previously told a judge the CO GOP
SCC did not pass a motion to fire Klenda and then had to backtrack when a
video showed them wrong).
The level of spite and vindictiveness is hard to believe. But keeping crucial,
pertinent information from the judge could potentially be fraud on the court
and arguably criminal. The ethical conflicts are mind boggling.
Vice Chair Eric Grossman says CO GOP lawyers will fight this. But as it stands
now, Klenda, through Brita’s betrayal, is oAicially owed $231,000 plus 18
percent interest. The Party was already bankrupted by Horn’s disastrous
leadership and as of May 1st Klenda can seize whatever money is in current
Party bank accounts and assets and any future money until he gets the
$231,000 plus interest. (BTW the 18% interest Horn agreed to is far in excess
of the normal judgment interest of 8%).
It’s clear what’s in this for Klenda and the obvious question is – what’s in it for
Brita? As always, follow the money.
